- The Lord Advocate told the court Alister Jack's decision to use a Section 35 order cannot be seen as "reasonable or rational" and is therefore unlawful.
- She argued that Jack made his decision based on a policy disagreement with the Scottish Government rather than correctly under the rules of the Scotland Act.
- The Lord Advocate also said Jack did not read all the relevant evidence required before making a decision, with the majority of documents and letters coming from those "hostile to the bill".
